Non-Refundable Policy

This Non-Refundable Policy (“Policy”) sets forth and governs the terms, conditions, limitations and exclusions applicable to any and all payments, fees, costs and monetary consideration of any nature whatsoever (collectively referred to as “Fees”).

This Policy applies to every individual or entity (“Subscriber,” “User,” or “You”) that tenders, remits or otherwise provides Fees to NGO Fly by VakilKaro (“Company,” “We,” or “Our”) for the Software and related services.

This Policy governs all Fees paid for the NGO Fly by VakilKaro Software and related services, including subscription charges, implementation costs, maintenance fees, support fees, third-party charges, promotional plans and any other payment made in connection with the Services.

By using the Software in any manner, You acknowledge and agree to the terms and conditions of this Policy, including its binding nature, limitations and exclusions.

3.1 Subscription Fees

Subscription Fees are non-refundable for any reason, including non-use, dissatisfaction or changes in business requirements.

3.2 Implementation and Setup Fees

Implementation and setup charges become non-refundable once work has commenced.

3.3 Maintenance and Support Fees

Maintenance, service and support Fees are fully non-refundable.

3.4 Third-Party Fees

The Company is not liable for refunding charges imposed by payment processors, integrations or other third parties.

3.5 Promotional Offers

All discounted, promotional, trial-related or specially priced Fees are final.

Prospective Cancellation Only

Cancellations take effect prospectively. No refund shall be provided for unused subscription time or prepaid amounts.

Where applicable, access may continue until the end of the current billing cycle.

Upgrades

Upgrades and other service modifications are subject to the Fees and terms applicable to the newly selected plan.

Downgrades

Downgrades take effect from the next billing cycle only. No refund or credit will be provided for previously paid Fees.

Strictly Non-Refundable

All Fees are strictly non-refundable unless a refund is explicitly required by Applicable Law.

The Software is provided on an “as-is” basis. The Company assumes no liability for dissatisfaction, non-use, limited usage or temporary service outages.

7.1 Mandatory Legal Compliance

Refunds shall only be issued where expressly mandated by Applicable Law.

7.2 Duplicate Transactions

A verified duplicate transaction may be eligible for refund where proof is submitted within thirty days.

7.3 No Broader Waiver

No circumstance other than those expressly listed in this Policy shall create an entitlement to a refund.

7.4 Limitation of Liability

Any refund, where legally applicable, shall be limited to the actual Fees received by the Company.

7.5 No Chargebacks Without Prior Notice

You must first submit a refund request through the Company’s designated channels before initiating a chargeback.

8.1 Notice Requirement

Disputes must be submitted within fifteen calendar days with all supporting documents.

8.2 Interim Payment

The Subscriber must pay all undisputed Fees while the disputed amount is under review.

8.3 Review Process

The Company will review the dispute and communicate its decision within thirty days.

8.4 Governing Terms

Applicable dispute provisions shall be determined by the Terms of Service or Subscription Agreement.

8.5 Improper Chargebacks

A chargeback initiated without compliance with this procedure shall constitute a breach of this Policy.

8.6 Rights Reserved

The Company may pursue legal action for breach, wrongful chargeback, fraud or non-payment.

This Policy shall be governed by the laws applicable in Jaipur, Rajasthan. All legal disputes shall be subject to the jurisdiction of courts in Rajasthan.

The Company reserves the right to modify this Policy at any time.
